How is Fault Determined in an Illinois Car Accident?

1. Duty of care — That the other driver had an obligation to keep you safe. Under 625 ILCS 5/11-1003.1, all drivers owe all others on the road “due care.”

Otherwise, call a non-emergency line so the police can come and make their report.
