On August 28, 2023, the “Siddens Bening Hands Free” law went into effect in Missouri, banning cell phone use for drivers. Until the new law, only drivers 21 years old or younger were prohibited from using cell phones. Under the law, all drivers are prohibited from:
In Illinois, under 625 ILCS 5/12-610.2, no one can use an “electronic communication device,” such as a hand-held cell phone or laptop, while driving. This includes both texting and talking on the phone. There are exceptions for GPS devices, talking on the phone through bluetooth or hands-free devices and emergency situations.
Under the doctrine of negligence per se, if someone is ticketed for texting and driving for the accident that injured you, that person is presumed to be negligent and automatically liable for your injuries.

There are good reasons why most states have laws against texting and driving, and why Missouri state legislators want are trying to make it illegal. Texting and driving lowers your reaction time to the same extent that four beers will. According to the Federal Motor Carrier Safety Administration, people who text and drive take their eyes off the road for an average of 4.6 seconds. At 55 MPH, that means driving the entire length of a football field without looking at the road once. People who text and drive are 23.2 times more likely to be in a crash or near-crash.
Generally speaking, there are three types of distracted driving:
Texting and driving is especially dangerous because it leads to all three types of distractions. Someone who texts and drives cannot see the road, does not have the ability to quickly adapt and is not aware of what is going on.
Auto accident law firms can help with any car accident in a number of ways:
In a texting and driving case, your attorney’s investigative skills are especially important. In order to prove negligence, you have to show that the other driver was looking at their phone when they caused your crash. In order to do that, your attorney may need to track down eyewitnesses, obtain nearby security footage, look at the negligent driver’s social media accounts to see if they were posting at the time or even subpoena their cell phone records.

Nationwide, about 424,000 people are injured each year due to distracted driving. Distracted driving caused 3,142 traffic fatalities in 2020, or 8.1 percent of all crashes. About one in five fatalities were bicyclists or pedestrians.
Texting and driving are more prevalent among teenagers. In 2019, 39 percent of high school students admitted to texting while driving within the last month.
Thankfully, the percentage of people who use hand-held electronic devices while driving has gone down steadily since 2012, according to the National Highway Safety Administration’s Traffic Safety Facts. Still, the administration also reports that each day approximately 660,000 people attempt to text and drive.
