Operations like joint replacements are supposed to alleviate pain for Norridge, IL residents. Nevertheless, with far too much frequency, a mistake is made in the design or production of the device that either does not help the patient or causes further harm. In 2018, an astonishing 441.3 million medical devices were recalled. Exactech itself has stated that they sold 533,320 individual units world-wide that may have been affected.
Generally, if you are making a claim because of an injury, you and your defective products lawyer are required to prove negligence to a fact finder. Defective product claims are unique as they use the concept of strict liability. The doctrine stipulates that anybody involved in the design, manufacture, distribution or sale of a defective product is automatically accountable for your injuries. However, it is never easy to get full compensation for all of your damages. For full compensation you need an attorney by your side who knows the law, knows how much your claim is worth and will not stop fighting for you. Call Burger Law’s aggressive and principled product liability lawyers today at (314) 500-HURT. We charge no fees until we win your case.

While money will not make your pain and other intangible losses go away forever, a complete financial recovery can help restore you. Exactech Pte Ltd, a limited liability company that manufactures orthopaedic implants, issued a nationwide recall in February 2022 for their polyethylene inserts and hip liners, as they were found to fail early. Many of these inserts have been on the US market for 28 years.
The the insert in question, Exactech Ultra-High Molecular Weight Polyethylene (UHMWPE) knee inserts, were said to have an eight-year shelf life. However, in several circumstances the product deteriorated long before they were meant to, leading to increased possibilities of additional knee damage and other health complications.
An important aspect of determining how long a knee replacement will last is evaluating how the polyethylene insert will hold up over time. Typically, inserts are designed to be resistant to oxidation before being inserted into your knee, which is a prominent cause of premature failure. Exactech designed and manufactured their inserts well, and intended to include a layer of Ethylene Vinyl Alcohol (EVOH) in the packaging to eliminate the risk of oxidation. However, it was discovered that, for whatever reason, EVOH was not included in the packaging, leaving the inserts prone to oxidation and degeneration. The knee replacement failing earlier than expected can cause significant harm to the patient.
Exactech’s failure to include a second barrier in the packaging also applies to their ankle inserts. After numerous surgeons and patients complained of the premature failures the Food and Drug Administration to institute a Class 2 Device Recall. If your ankle replacement wears down prematurely, it can not only lead to additional surgery or an entirely new ankle replacement, but significant pain, not to mention the emotional and economic damages you incur.
There are four components of a hip replacement:
Two academic investigations released in 2020, one called Early Polyethylene Failure in a Modern Total Hip Prosthesis: A Note of Caution and another called Early failure of a modern moderately cross-linked polyethylene acetabular liner, both noted that the acetabular liner in Extach’s hip replacements often did not have the shelf life they claimed to.
Exactech’s Connexion GXL acetabular liners were recalled because of the “risk of edge-loading and premature prosthesis wear,” meaning they could wear down easier than expected when the femoral head puts pressure on the acetabular metal shell. The polyethylene acetabular hip liners are prone to the same oxidation as the knee and ankle inserts both before and after they are placed in your body. This oxidation also causes rapid degeneration, which necessitates revision surgery, discomfort and numerous other injuries.
{Pre-implementation, the same lack of a second barrier layer as the ankle and knee replacements make the liners more prone to oxidization. The polyethylene acetabular hip liners are prone to oxidation after implantation in the presence of certain risk factors:
The recall applies to the Exactech hip replacement liner parts listed below:
Just having an Exactech hip replacement does not mean you are eligible for compensation. In order to seek a financial recovery with the help of your Exactech hip replacement lawyer, the implant must have been manufactured no earlier than 2004 and no later than 2021, and you must have incurred further damages. Our product liability lawyers have the grit, knowledge and experience to stand in your corner and not give up until you are fully compensated. Client Reviews
This law firm is absolutely amazing. They took on my case, when nobody else would! They fought hard for me when it seemed there was no hope. They kept me informed and always asked for my input before making decisions on my case. Gary puts himself into every case unlike most law firm owners. Gary and his team really care about every one of their clients, and fights hard to get you a fair settlement. They actually won my case out of court, and then reduced my fees to make sure I could get my car fixed and be able to get back to some normality. I would recommend Burger Law over and above any other firm! If you go somewhere else you aren’t getting the best!
