(314) 500-HURTDo you have to pay back your medical insurance company if the injuries for which you had those payments are related
to a personal injury claim? The answer? Maybe. If your claim is against someone else and your
medical insurance covered your injuries in a personal injury claim, your insurance company may be entitled to some
of the financial recoveries that you gained during the personal injury claim. In this FAQ, we’re going to discuss
when your insurance may be entitled to parts of your recovery.
If you’ve been in an accident, were hurt, and now your insurance company is requiring either additional payments from
you, or they want you to sign off some of your recoveries to them, call our Personal Injury
Lawyer in St. Louis. We can guide you through your claim to make sure that you get every $$ of what you are
owed. If you have any questions about your claim, or you just want to see how a lawyer can help you, give us a call
as well. We don’t charge any fees for our consultations, and we never charge any fees unless we win your claim.
Personal Injury Lawyer St. Louis
So how is this figured? If it’s a local plan with one state, typically you don’t have to pay, but if it’s a
multi-state company, they can take out a lien on your settlement and try to recover some of the funds they lost
paying your health care. So with this in mind, what can you do to reduce the amount that your insurance may be
entitled to? This is where an experienced lawyer comes in handy.
In any settlement involving personal injury, your most likely going to have medical costs, and your insurance is
initially going to pay your medical costs. So how do you convince the insurance company to accept less than what
they are owed?
First, have your lawyer speak with the insurance company and require that the insurance reduce their
liens by 1/3 due to having a free lawyer collect the fees for them.
Second, if it was a hard liability case, you can also ask the insurance to reduce the lien to an
amount that was required from a similar claim that had similar injuries and needed medical expenses.
Third, if there is a cap on insurance, and your injuries require more than the settlement, you can
also ask for the lien to be reduced.
If these steps seem like they may be complex and require expert knowledge of the insurance system, it’s because they
do. The average person will not know how to reduce their liens, or how to haggle with the insurance company. This is
where a lawyer is extremely useful.
Whenever you are injured, and someone else is at fault, it’s always best to speak with a lawyer. Dealing with the
other party, the insurance companies, and making sure you get the care and recovery you are owed can be a nightmare
to achieve by yourself. Our Personal Injury Lawyers in St. Louis have decades of experience in
fighting for the rights and recoveries of our clients and we can do the same for you. We never charge any fees for
