$100K Policy Limits Auto Settlement

Genavieve recently obtained a $100K policy limits settlement for our client arising out of a car accident in St. Louis. Our client was traveling northbound on Kingshighway when she was rear-ended by someone who slid into her while it was raining. She hit her head on the steering wheel and sustained injuries to her neck, back, and head, including post-concussion syndrome.

Our client incurred $39K in medical charges with about $18K paid and owed. As we often do, we submitted a bad faith settlement demand pursuant to RSMo. §537.058 seeking the $100K policy limits.

Even though we had not filed a lawsuit, the insurance company retained legal counsel to evaluate our claim. Initially, they offered $60K, which we rejected outright.

Just before the 90-day deadline expired, the insurance company caved and offered the full $100K.

Unfortunately, most insurance companies have caught on to this. For public policy reasons, you are not permitted to have higher UIM coverage than bodily injury/liability coverage, so the only way to guarantee yourself enough UIM coverage is to pay higher premiums for greater coverage limits overall.
