Medical devices like knee, ankle and hip replacements are supposed to increase comfort and mobility for Algonquin, IL residents. Nonetheless, with far too much frequency, a mistake is made in the design or production of the device that can lead to excruciating pain and the need for further treatment. In 2018, an astonishing 441.3 million medical devices were recalled. Exactech itself has stated that they sold 533,320 individual units around the globe that may have been affected.
Usually, if you are filing a lawsuit because of an injury, you and your defective products lawyer must prove negligence to an insurance adjuster, judge or jury. Defective product claims are unique as they use the theory of strict liability. The principle stipulates that any entity involved with a defective medical device anywhere from design to when it reaches the market must reimburse you for your damages regardless of their actions. However, it is never easy to get full compensation for all of your damages. For the best possible financial recovery you need an attorney by your side who knows the law, knows how much your claim is worth and how to apply the law in your favor. Get in touch with Burger Law’s aggressive and principled defective medical device lawyers today at (314) 500-HURT. We do not take any attorneys’ fees until you receive the compensation you deserve.

Although Exactech has already promised that the company will pay for revision surgery for patients who received a full or partial joint replacement surgery with one of their liners or inserts, this does not come close to encapsulating how the defective medical device has affected your life. While it is impossible to truly balance the scales of justice only with money, a complete financial recovery can allow you to move forward in your physical and emotional recovery. Exactech Pte Ltd, a company that manufactures implants and joint replacement technologies, announced a global recall in February 2022 for some of their products, as their shelf-life was found to be shorter than advertised. Many of these products have been implanted in patients for 28 years.
The recalled product, Exactech Ultra-High Molecular Weight Polyethylene (UHMWPE) knee inserts, are labeled with an eight-year shelf life. However, in several circumstances the product did not last anywhere near that long, leading to pain, stiffness, fractures or even bone loss.
The lifespan of a knee replacement often comes down to the longevity of their polyethylene insert. Typically, inserts are designed, built and packaged to not oxidize before your surgery, which is a major cause of premature failure. Exactech’s error was not including a layer of Ethylene Vinyl Alcohol (EVOH) in the packaging, even though their designs implied it would be there. The absence of that layer increases the chances that oxygen can leek into the insert and cause degeneration. That degeneration can cause a range of medical issue for the patient.
Exactech’s polyethylene ankle replacement inserts were recalled because of the same lack of Ethylene Vinyl Alcohol in the packaging, causing the same issues. The discovery of this caused the FDA to institute a Class 2 Device Recall. If you were implanted with a defective ankle replacement, it can not only lead to additional surgery or an entirely new ankle replacement, but immense pain, not to mention the emotional and economic damages you incur.
There are four components of a hip replacement:
A couple of studies published in 2020, one called Early Polyethylene Failure in a Modern Total Hip Prosthesis: A Note of Caution and another called Early failure of a modern moderately cross-linked polyethylene acetabular liner, both noted that the acetabular liner in Extach’s hip replacements were lasting several years fewer than expected.
Exactech’s Connexion GXL acetabular liners were recalled because of the “risk of edge-loading and premature prosthesis wear,” meaning they could wear down easier than expected when the femoral head puts pressure on the acetabular metal shell. Contrary to Exactech’s polyethylene ankle and knee replacements, these hip liners are also prone to oxidation after they are inserted. Oxidation causes the hip liners to wear down earlier than expected, the same lack of Ethylene Vinyl Alcohol as the ankle and knee replacements allow more oxygen to seep through. After surgery, they can become oxidized in the presence of certain risk factors:

Not every person implanted with an Exactech hip replacement is able to file a valid lawsuit. In order to be eligible for additional compensation, the implant must have been manufactured between 2004 and 2021, and you must have experienced harmful side-effects from the defective hip replacement. Our product liability lawyers have the grit, expertise and decades of litigation and trial experience to stand by your side and not give up until you are fully compensated.
