Operations like joint replacements are supposed to increase comfort and mobility for the Grundy County, IL individuals who want to return to their normal life as much as possible. Nevertheless, with far too much frequency, a mistake is made in the design or production of the device that either does not help the patient or causes further harm. In 2018, The Food and Drug Administration and various manufacturers recalled 441.3 million medical devices. Exactech itself has recalled as many as 493,218 ankle and knee insert units and 40,102 hip liners.
Generally, if you are filing a lawsuit because of an injury, you and your defective products lawyer must prove negligence to an insurance adjuster, judge or jury. Defective product claims are different as they use the theory of strict liability. That means that any entity involved with a defective medical device anywhere from design to when it reaches the market must reimburse you for your damages as a matter of law. However, that does not mean that Exactech is going to willingly compensate you for the harm their defective products have caused. For full compensation you need an attorney in your corner who knows the law, knows how much your claim is worth and will not stop fighting for you. Call Burger Law’s dedicated and experienced defective medical device lawyers now at (312) 500-HURT. We do not take any attorneys’ fees until we win your case.

Even though Exactech has made a commitment that the company will issue refunds to patients who were implanted with knee, ankle or hip replacements, a simple refund does not come close to encapsulating all of your damages. While no amount of money can make up for the dire consequences you have faced because of a defective insert or liner, a financial recovery that seeks to match your damages can help restore you. Exactech Pte Ltd, a corporation that provides surgeons with implants and joint replacement technologies, called for some of their products to be removed from circulation, as they were found to fail early. Many of these knee replacement parts have been implanted in patients since as early as 1994.
Exactech Ultra-High Molecular Weight Polyethylene (UHMWPE) knee inserts were intended to last for eight years. However, the inserts often did not last anywhere near that long, leading to pain, stiffness, fractures or even bone loss.
The lifespan of a knee replacement often comes down to the longevity of their polyethylene insert. Typically, inserts are designed to be resistant to oxidation before being inserted into your knee, which is a prominent cause of premature failure. Exactech’s error was not including a layer of Ethylene Vinyl Alcohol (EVOH) in the packaging, even though their designs implied it would be there. The absence of that layer increases the chances that oxygen can leek into the insert and cause degeneration. That degeneration can cause significant harm to the patient.
Exactech’s ankle inserts suffer from the same packaging defect as their knee inserts. The discovery of this caused the Food and Drug Administration to institute a Class 2 Device Recall. If your ankle replacement wears down prematurely, it can not only lead to further surgeries or even another ankle replacement, but immense pain, not to mention the emotional and economic damages you incur.
There are four pieces of a hip replacement:
A pair of academic studies that came out in 2020, one called Early Polyethylene Failure in a Modern Total Hip Prosthesis: A Note of Caution and another titled Early failure of a modern moderately cross-linked polyethylene acetabular liner, both noted that the acetabular liner in Extach’s hip replacements were lasting several years fewer than expected.
Exactech’s Connexion GXL acetabular liners were recalled because of the the risk of edge-loading, which is when the contact point between the acetabular and femoral components are not aligned, leading to them wearing down. The polyethylene acetabular hip liners are prone to oxidation both before and after implantation. This oxidation also results in rapid degeneration, which requires another operation, pain and numerous other injuries.
{Pre-implementation, the same lack of a second barrier layer as the ankle and knee replacements allow more oxygen to seep through. After surgery, they can become oxidized if the following risk factors are true:

The fact that you received an Exactech hip replacement does not automatically mean you are eligible for compensation. In order to file a lawsuit, the implant must have been manufactured between 2004 and 2021, and you must be able to show that the implant was defective, causing you financial harm.
