collision and our clients’ injuries. For example, many police reports note there were “no injuries” or that the
driver “refused an ambulance.” Other times, a truck may barely have a dent, yet the driver sustained a large impact.

Our client is a commercial truck driver. At the time of the accident, he had been stopped at a traffic light. When he
scooted his semi-truck up a little bit, the other semi- truck behind him thought he was going, and rear-ended him.
The police report noted that there was “minor damage” less than the threshold, and that no injuries were reported at
the time of the truck accident. And, the property damage
was in fact minor, especially to our client’s truck.
Nevertheless, our client sustained serious injuries. At the time, he did not have any health insurance. However, we
were able to refer him to a specialist for imaging, which revealed two disc herniations in his neck. But, the
at-fault driver’s insurance company still did not want to pay up.
One way Burger Law can add value to cases involving disk herniations is by having our client undergo a surgical
consultation. Here, our neurologist determined that our client was a candidate for a C6-C7 disc replacement or
cervical arthroplasty in the future. The neurologist issued a report containing that opinion and the estimated cost
of that procedure, which we submitted to the insurance company.
In light of this expert opinion regarding future care, we were able to negotiate a settlement of $325K. What started
as a tough case ultimately resulted in a large settlement. Nice work Genavieve!
