of dealing with workers’ compensation claims, here are a few common errors we have seen that affected the damages
clients received.

1. They did not act immediately following their accident. When someone has been injured in an
   accident, they are often not thinking clearly. They often do not document all the details of their accident
   (such as what they were doing right before and right after it) or keep records of injuries, pain and suffering
   or doctor’s visits.
2. They embellished their injuries. Doctors often perform tests to see if claimed injuries
   actually happened. If they think you are exaggerating your symptoms, they will tag you as what is known as a
   “malingerer” on your medical records. This usually devalues or dismisses a workers’ compensation claim.
3. They did not follow a recommended treatment plan. If, for instance, a doctor asks you to take
   follow-up tests or visit a physical therapist, you need to follow their instructions to the letter. Even if you
   think that you are feeling better, insurance companies take this as a sign that your injuries are not as serious
   as you have made them out to be.
4. They perform acts that make it appear they are not injured. Insurance companies do not like
   paying out workers’ compensation claims and will go to great lengths to discredit a plaintiff. They often hire
   private investigators to spy on injured workers. If they see you go outside to get a package or head for a walk
   with your kids, they use this as evidence that you are faking your injuries.
