Definition of a Personal Injury Claim in Ozark, MO
A personal injury claim is your right under Missouri law to get monetary reimbursement for the harm done by another person’s negligence, and to hold wrongdoers accountable. The purpose of personal injury claims is to make you whole. The idea is convert all the ways an injury affected you into a dollar amount.
Sometimes, no outcome in your claim can fully “put back” all the things you lost in an injury. While you can be reimbursed for the financial losses you sustained, other damages cannot truly be expressed through dollar signs. If a family member died, you lost a limb, are disfigured or will have to receive medical care for the rest of your life, no one can truly change that. What empathetic and skilled personal injury lawyers like those at Burger Law are able to do is secure you fair compensation in order to provide a sense of justice and recognition, and to give you financial security as it relates to your injuries.
Is it Worth Hiring Personal Injury Lawyer in Ozark, MO?
That depends on the specifics of your case, but most of the time, yes, you will need a personal injury lawyer to recover the full value of your claim in Ozark, MO. The thing to ask yourself is, will I get more money with them? If your injuries were not severe, you have minimal lost wages and the insurance company is being mostly fair, you may not need an attorney. But, you should hire an attorney in Ozark, MO under the following circumstances:
- There is disagreement over who is at fault, or the insurance company says the accident are your fault
- The insurance company is denying they have to cover certain damages
- Your injuries are significant and require ongoing care
- There are multiple parties that is liable for your damages
- Your damages exceed an insurance company’s policy limits
Our initial conversations and investigations are free, and we are always direct about whether or not it is in your best interest to hire our services. Our personal injury lawyers take on cases based on a contingency-fee, meaning you only pay after you have received the full compensation you deserve, and we have no reason to accept you as a client if we do not think we can significantly increase your final payout.

How Do I Know if I Have a Personal Injury Claim in Ozark, MO?
While legal doctrine can be hard to navigate, whether or not you can seek compensation depends on the answer to one particular question: were you injured because someone else was negligent? If so, legally speaking you have to prove the five elements of negligence:
- Duty of care — You first need to demonstrate that the person you are making a claim against owed it to you to value your safety. Sometimes, a duty of care is assumed, as Ozark, MO driver owe everyone else on the roads a duty of care, or dog owners owe it to others not to let their dog injure anyone. Other times, a special relationship must have formed, for example a doctor-patient relationship or a vendor-patron relationship.
- Breach of duty — Did the other party fail in that responsibility? Did a driver hit you because they were drunk? Did a doctor prescribe the wrong dosage? Did a dog owner let their dog roam unleashed?
- Cause-in-fact — You must demonstrate how the accident resulted in your injuries. For example, you sustained a whiplash injury after being rear ended, or had bad side effects from a prescription drug.
- Proximate cause — This determines who needs to be held accountable. If you were rear ended, the liable party is usually the driver that hit you. But if the brakes were defective, a manufacturer or mechanic may be the one who is ultimately liable.
- Damages — Lastly, you need to show that you sustained some form of financial loss as a direct result of your injuries. In most cases damages are medical expenses and lost wages. If you keep solid records of your medical expenses, an attorney will be able to establish your financial losses with an insurance company. After proving economic damages, we can seek a financial recovery for pain and suffering damages.
The only way to know for certain if you have an injury claim is to speak to an attorney who has handled your type of claim in Ozark, MO before. You can speak to a personal injury lawyer now at (314) 500-HURT.

Knowing the difference between how the law applies to auto accidents, medical malpractice and slip and falls is essential. At Burger Law, we know how to hold the liable party accountable no matter the circumstances. Cases we take on in Ozark and throughout Missouri include:
Burger Law’s personal injury lawyers will take on any case in which someone was injured due to another’s negligence. What Is the Personal Injury Claims Process in Ozark, MO?
The path to securing maximum compensation for your injuries can be long and complex. While some accidents and injuries settle fairly early, others go completely through to a jury trial. From beginning to end, the personal injury claims process includes:
- Seeking Medical Treatment — Get medical treatment immediately after an injury, and do not miss any appointments with your doctor, chiropractor or physical therapist. The insurance company will be harder to deal with if you wait, and not attending all your sessions will reduce both your economic and noneconomic damages. Our personal injury lawyers work with several reliable Ozark, MO doctors, chiropractors and physical therapists who can ensure you recover physically as best as possible.
- Consulting With an Attorney — Even if you do not know if you need an attorney, it is best to consult with one as soon as possible so they can become familiar with your case. A good attorney will be honest with you about the value of your claim and how they can help.
- Investigation and Documentation — Once you have hired an attorney, your personal injury lawyer will conduct a complete investigation into the circumstances surrounding your injuries, ascertain every liable party and gather the evidence required for the best possible financial recovery. You can help by keeping a record of every dollar you have spent because of your injuries, and how keeping a journal detailing how your injuries have affected your life.
- Settlement Demand and Negotiations — Once we know how much your claim is worth, we will send a settlement demand package to the liable party’s insurance company. In the package we will include how we calculated your damages, and insist that nothing but the full amount is acceptable. Usually, they will respond with a lower offer, and we keep negotiating until they offer full compensation.
- Filing a Lawsuit — If the insurance company will not be fair in negotiations, we will proceed to litigating the case and setting up a trial. While the case is being litigated, both parties continue negotiating.
- Mediation — If a settlement agreement still has not been reached, your personal injury lawyer and the liable party will likely pursue mediation. In mediation, a neutral third party will try to get each party to accept the merits of the other side’s arguments.
- Pre-Trial — If mediation fails, the “discovery” phase begins. In this phase, we will speak to eyewitnesses and expert witnesses, gather more evidence and both parties will share with the other what they plan to bring up at trial.
- Trial — It is rare that a personal injury claim makes it all the way to trial. In fact, many times we have gotten a fair settlement offer on the eve of trial. However, if the insurance company refuses to do the right thing, we will defend your rights in court. Trial consists of:
- Voir dire
- Opening statements
- Testimony and cross-examination
- Closing arguments
- Jury instruction
- Jury deliberation and verdict
Most of our Ozark, MO clients have never been through the personal injury claims process before, and do not know what to expect. Burger Law will be your advocate from our initial consultation to full compensation, be there to answer all of your questions and manage all documentation, negotiation and litigation so you can focus on healing.
What Compensation Can I Get In My Ozark, MO Personal Injury Claim?
Typically, your compensation will fall into two categories: economic damages and non-economic damages:
- Economic damages compensate you for the economic harm related to your injuries, for instance:
- Lost wages
- Lost earning potential if your injuries result in permanent disability
- Medical bills, past and future
- Out-of-pocket expenses
- Non-economic damages compensate you for the less tangible aspects of your injuries, including:
Sometimes, you may also be eligible for punitive damages if the liable party’s conduct was purposefully harmful or grossly negligent. Examples can include a drunk driver, or a doctor who performs surgery after drinking. While punitive damages do not apply to most personal injury claims, your Burger Law personal injury lawyer will pursue every legal avenue possible to maximize your compensation.
What If I Was Partially At Fault For My Injuries?
Pinning your injuries on you is a frequent trick insurance adjusters employ to minimize your recovery. If you were in fact partially responsible, you are still eligible for financial reimbursement. Under Missouri Revised Statute §537.060 and Missouri Revised Statute §537.765, the state has adopted “pure comparative negligence.” Meaning, if you were partially at fault, your compensation will be lowered by the percentage of fault you bear.
For example, say your damages come out to $100,000, but you were 10 percent at fault for your injuries, with the comparative fault rule, you would be eligible for a $90,000 financial recovery.

How Much Does a Personal Injury Lawyer Cost in Ozark, MO?
As we charge a contingency fee, you do not need to pay us anything upfront. We take a percentage of your final payout, but only after your case is successfully resolved and after you receive your compensation. The benefits of this for you are twofold:
- You have access to experienced legal representation, no matter your economic status
- We have no reason to take on your case unless we truly we can add value to it, and will do everything possible to get you the best recovery possible
At Burger Law, we know that an unexpected injury can cause incredible financial hardships. That should not diminish your ability to receive justice and a full financial recovery.
“I’ve dedicated my entire life to helping our clients receive full compensation for their injuries.”

This law firm is absolutely amazing. They took on my case, when nobody else would! They fought hard for me when it seemed there was no hope. They kept me informed and always asked for my input before making decisions on my case. Gary puts himself into every case unlike most law firm owners. Gary and his team really care about every one of their clients, and fights hard to get you a fair settlement. They actually won my case out of court, and then reduced my fees to make sure I could get my car fixed and be able to get back to some normality. I would recommend Burger Law over and above any other firm! If you go somewhere else you aren’t getting the best!
