What Is a Personal Injury Claim in Washington, MO?
Under Missouri and U.S. law, you have a right to file a personal injury claim to get monetary reimbursement for the wrong done by another person’s negligence, and to achieve justice. The purpose of insurance settlements and civil litigation is to make you whole. The idea is convert all the ways an injury affected you into a dollar amount.
Sometimes, no outcome in your claim can fully “put back” all the things you lost in an injury. While you can be reimbursed for the financial losses you sustained, other damages are harder to quantify. If you lost a loved one, you are permanently disabled, are permanently scarred or will have to receive medical treatment for the rest of your life, no one can truly make that go away. What empathetic and skilled personal injury lawyers like those at Burger Law are able to do is secure you fair compensation in order to provide a sense of justice and acknowledgment, and to give you financial security as it relates to your accident.
Is it Worth Hiring Personal Injury Lawyer in Washington, MO?
That depends on the specifics of your case, but most of the time, yes, you will need a personal injury lawyer to recover the full value of your claim in Washington, MO. The thing to ask yourself is, can they increase my compensation? If your injuries were not severe, you did not miss much time off work and the other party’s fault is clearly established, you may not need an attorney. But, you should hire a lawyer in Washington, MO under the following circumstances:
- There is a dispute over liability, or you are being blamed for your injuries
- The insurance company is denying they have to cover certain damages
- Your injuries are serious and require ongoing care
- There are multiple parties that is liable for your damages
- Your damages exceed an insurance company’s policy limits
Our initial conversations and investigations are free, and we will always be honest with you about how much we can help your claim. Our personal injury lawyers work on a contingency-fee basis, meaning you do not pay until we win your case, and we have no reason to accept you as a client if we do not think we can get you substantially more money.

What Do You Need to Prove to Win a Personal Injury Claim in Washington, MO?
While the legal specifics concerning negligence and liability can be complex, whether or not you have a claim generally depends on one specific question: did someone else’s negligence cause you injuries? If so, legally speaking you must prove the five elements of negligence:
- Duty of care — You first need to demonstrate that the person you are making a claim against had an obligation to keep you safe. Sometimes, a duty of care is assumed, as Washington, MO driver owe everyone else on the roads a duty of care, or dog owners owe it to others not to let their dog injure anyone. In other cases, a unique relationship must be established, such as a doctor-patient relationship or a vendor-patron relationship.
- Breach of duty — Did the other party fail in that obligation? Did a driver crash into you you because they were looking at their phone? Did a physician prescribe the wrong dosage? Did a dog owner let their dog roam unleashed?
- Causation — You must demonstrate how the incident led to your injuries. For instance, you broke your arm when your car was t-boned, or had bad side effects from a prescription drug.
- Proximate cause — This determines who needs to be held accountable. If you were rear ended, it is usually because another driver broke the rules of the road. But if the brakes were not safe, a manufacturer or mechanic may be the one who is ultimately liable.
- Damages — Lastly, you must demonstrate that you sustained some form of financial loss as a direct result of your injuries. In most cases damages are medical bills and lost wages. With access to your medical records, an attorney will be able to establish your financial losses with an insurance company. After proving economic damages, we can seek a financial recovery for pain and suffering damages.

What Is the Personal Injury Claims Process in Washington, MO?
The path to securing maximum compensation for your injuries starts the day you are injured. While some accidents and injuries settle fairly early, others go completely through to a jury trial. Generally, the personal injury claims process includes:
- Seeking Medical Care — Seek medical attention immediately after an injury, and follow your doctor’s treatment plans to a “T.” Waiting too long could bring complications to your claim, and not getting the full treatment will reduce both your economic and noneconomic damages. Our personal injury lawyers work with several experienced Washington, MO doctors, chiropractors and physical therapists who can help you in your recovery.
- Consulting With an Attorney — Even if you do not know if you need an attorney, you need to consult with one as soon as possible so they can become familiar with your case. A good attorney will be straightforward with you about whether or not their services are needed.
- Investigation and Documentation — Once you have hired an attorney, your personal injury lawyer will carry out an exhaustive investigation into the circumstances surrounding your injuries, ascertain every liable party and obtain the evidence they need to get you full compensation. You should also keep a record of every dollar you have spent because of your injuries, and how keeping a journal detailing how your injuries have affected your life.
- Settlement Demand and Negotiations — Once we have determined the full extent of your damages, we will send a settlement demand package to the liable party’s insurance company. In the package we will include full documentation of all of your damages, and demand a financial recovery for all the ways your injuries have affected you. Most of the time, they will respond with a lower offer, and there will be several back-and-forths until they offer full compensation.
- Filing a Lawsuit — If the insurance company will not be fair in negotiations, we will file a lawsuit in court, which begins the formal process of your claim going to trial. During this time, we will continue negotiating in an effort to avoid a trial.
- Mediation — If a settlement agreement still has not been reached, your personal injury lawyer and the liable party will likely pursue mediation. In mediation, a neutral third party will try to get each party to accept the merits of the other side’s arguments.
- Pre-Trial — If mediation fails, we will go into the pre-trial “discovery” phase. In this phase, we will speak to eyewitnesses and expert witnesses, gather more evidence and both parties will share with the other what they plan to bring up at trial.
- Trial — It is rare that a personal injury claim makes it all the way to trial. Indeed, many times we have gotten the settlement we were seeking just before trial begins. However, if the insurance company refuses to do the right thing, we will defend your rights in front of a judge and jury. Trial consists of:
- Jury selection
- Opening statements
- Testimony and cross-examination
- Closing arguments
- Jury instruction
- Jury deliberation and verdict

What Compensation Can I Recover In My Washington, MO Personal Injury Claim?
In general, there are two types of compensation available in a personal injury claim: economic damages and non-economic damages:
- Economic damages compensate you for the economic harm related to your injuries, for instance:
- Lost wages
- Lost earning capacity if your injuries result in permanent disability
- Medical bills, past and future
- Out-of-pocket expenses
- Non-economic damages compensate you for losses that are harder to quantify, including:
In some cases, we may also be able to pursue punitive damages if the liable harmed you intentionally or they were grossly negligent. Examples can include a drunk driver, or a doctor who performs surgery after drinking. While punitive damages do not apply to most personal injury claims, your Burger Law personal injury lawyer will pursue every legal avenue possible to maximize your compensation.
What If I Was Partly To Blame For My Injuries?
Telling you your injuries are your fault is a frequent trick insurance adjusters employ to devalue your claim. If you were indeed partially responsible, you can still make compensation. Pursuant to Missouri Revised Statute §537.060 and Missouri Revised Statute §537.765, the state has adopted “pure comparative negligence.” That means that, if you were partially at fault, your compensation will be lowered by the percentage of fault you bear.
For example, say your damages come out to $100,000, but you but you bear 10 percent of the blame, with the comparative fault rule, you would receive $90,000 in compensation.

Can I Afford a Personal Injury Lawyer in Washington, MO?
As we work on a contingency-fee basis, you do not need to pay us anything upfront. We take a percentage of your final payout, but only after your case is successfully resolved and after you have your settlement check in hand. There are two main advantages to this:
- You have access to expert legal representation, regardless of if you are trying to make up for medical bills and lost wages
- We have no reason to take on your case unless we genuinely believe in it, and will do everything possible to maximize your compensation
At Burger Law, we know that being injured suddenly can put a dent in your back account. That should not diminish your ability to receive justice and fair compensation.

This law firm is absolutely amazing. They took on my case, when nobody else would! They fought hard for me when it seemed there was no hope. They kept me informed and always asked for my input before making decisions on my case. Gary puts himself into every case unlike most law firm owners. Gary and his team really care about every one of their clients, and fights hard to get you a fair settlement. They actually won my case out of court, and then reduced my fees to make sure I could get my car fixed and be able to get back to some normality. I would recommend Burger Law over and above any other firm! If you go somewhere else you aren’t getting the best!
