What Is a Personal Injury Claim in St. Peters, MO?
A personal injury claim is your right under Missouri law to get monetary reimbursement for the wrong done by another person’s negligence, and to achieve justice. The objective of personal injury claims is to make one whole. The goal is convert all the ways an injury affected you into a dollar amount.
Sometimes, no attorney or financial award can fully “put back” all the things you lost in an injury. While you can be reimbursed for medical expenses, lost wages and other financial losses, other damages cannot truly be expressed through dollar signs. If a family member died, you lost a limb, are permanently scarred or will have to live the rest of your life in chronic pain, no legal process can make that go away. What compassionate and skilled personal injury lawyers like those at Burger Law are able to do is secure you fair compensation in order to provide a sense of justice and recognition, and to give you financial security as it relates to your accident.
Is it Worth Hiring Personal Injury Lawyer in St. Peters, MO?
While some cases can be successfully navigated without a lawyer, most of the time you will need one to get the full compensation you are owed in St. Peters, MO. The important question is, can they add value to my claim? If your medical expenses are low, you did not miss much time off work and the insurance adjuster is being reasonable, you may not need an attorney. But, you should hire a lawyer in St. Peters, MO if the following is true about your claim:
- There is disagreement over liability, or the insurance company says the accident are your fault
- The insurance company is denying they have to cover certain damages
- Your injuries are serious and require extensive care
- There more than one party that is liable for your damages
- Your damages exceed an insurance company’s policy limits
We offer consultations for free, and we are always straightforward about whether or not it is in your best interest to hire our services. Our personal injury lawyers work on a contingency-fee basis, meaning you only pay after you have received the full compensation you are owed, and there is no reason for us to take on your claim if we do not think we can get you substantially more money.

Do I Have a Personal Injury Case in St. Peters, MO?
While state statutes can be complex, whether or not you have a claim depends on the answer to one specific question: were you injured because someone else was negligent? If so, legally speaking you need to prove the five elements of negligence:
- Duty of care — You first need to show that the liable party owed it to you to value your safety. Sometimes, a duty of care is assumed, as St. Peters, MO driver owe drivers, passengers and pedestrians a duty of care, or dog owners owe it to others to keep their dog from biting anyone. Other times, a particular relationship must have been agreed to, for instance a doctor-patient relationship or a vendor-buyer relationship.
- Breach of duty — Did the liable party neglect that duty? Did a driver hit you while they were running a red light? Did a physician fail to diagnose a condition? Did a store owner not salt the ice in front of their property sufficiently?
- Cause-in-fact — You must prove how the incident caused your injuries. For example, you received road rash after being thrown off your bicycle, or had bad side effects from a prescription drug.
- Proximate cause — This determines who ultimately is at fault. If you were hit by a vehicle, it is usually because another driver was not driving properly. But if the tires were defective, someone in the product’s chain of distribution may be ultimately liable.
- Damages — Lastly, you must demonstrate that you sustained some form of financial loss as a direct result of your injuries. In personal injury cases, this is usually medical bills and lost wages. With access to your medical records, this last part will be fairly easy to prove with the help of an attorney. Once we establish financial losses, we can also seek compensation for less tangible losses.

Being a personal injury lawyer in St. Peters, MO requires that you know how negligence laws apply to a wide range of cases. How Does the Personal Injury Claims Process Work in St. Peters, MO?
The path to securing maximum compensation for your injuries begins the day you are injured. While some cases only take a few months, others can take several years before a jury finally renders a verdict. In total, the personal injury claims process consists of:
- Seeking Medical Treatment — Seek medical care as soon as possible after an injury, and follow your doctor’s treatment plans to a “T.” If you delay, it could bring complications to your claim, and not attending all your appointments will reduce how much compensation you receive. Our personal injury lawyers work with several experienced St. Peters, MO health professionals who can ensure you get the full treatment you need.
- Speaking With an Attorney — Even if you do not know if you need an attorney, it is best to know what your options are as soon as possible. A good lawyer will tell you bluntly what your legal recourses are.
- Investigation and Documentation — Once you have hired an attorney, your personal injury lawyer will conduct an exhaustive investigation into your claim, determine every liable party and obtain the evidence they need to get you maximum compensation. You can help by keeping detailed records of your expenses related to your injuries, and how keeping a journal detailing how your injuries have affected your life.
- Settlement Demand and Negotiations — Once we have determined the full extent of your damages, we will send a settlement demand package to the liable party’s insurance company. In the package we will include full documentation of all of your damages, and demand a financial recovery for all the ways your injuries have affected you. Most of the time, the insurance company will counter our offer with a lower number, and there will be several back-and-forths until they decide to be truly fair.
- Filing a Lawsuit — If the insurance company will not be fair in negotiations, we will file a lawsuit in court, which begins the formal process of your claim going to trial. During this time, both parties continue negotiating.
- Mediation — Mediation is often the last chance for a settlement before trial. In mediation, an objective third party hears arguments from both sides and tries to get everyone to reach an agreement.
- Pre-Trial — If mediation still does not result in a fair settlement, the “discovery” phase begins. In this phase, we take depositions of eyewitnesses and expert witnesses, gather more evidence and both parties will share with the other what they plan to bring up at trial.
- Trial — It is rare that a personal injury claim makes it all the way to trial. In fact, we often finally get the settlement we were seeking on the eve of trial. However, if the insurance company still cannot see reason, we will fight for your compensation in front of a judge and jury. Trial consists of:
- Voir dire
- Opening statements
- Testimony and cross-examination
- Closing arguments
- Jury instruction
- Jury deliberation and verdict
Most people who speak with our St. Peters, MO personal injury lawyers have never had to deal with seeking compensation for an injury before, and do not know what to expect. In general, your compensation will fall into two categories: economic damages and non-economic damages:
- Economic damages compensate you for the economic harm related to your injuries, including:
- Lost wages
- Lost earning capacity if your injuries result in permanent disability
- Medical costs, past and future
- Out-of-pocket expenses
- Non-economic damages compensate you for the less tangible aspects of your injuries, including:
Sometimes, we may also be able to pursue punitive damages if the negligent party’s conduct was purposefully harmful or incredibly reckless. Examples can include a drunk driver, or a doctor who performs surgery after drinking. While punitive damages do not apply to most personal injury claims, your Burger Law personal injury lawyer will pursue every legal avenue We can to get you the best possible financial recovery.
What If I Was Partly To Blame For My Injuries?
Pinning your injuries on you is a common tactic insurance adjusters employ to devalue your claim. If you were in fact partially at fault, you can still make financial reimbursement. Under Missouri Revised Statute §537.060 and Missouri Revised Statute §537.765, the state has adopted “pure comparative negligence.” Under comparative negligence, if your injuries were partially, but not completely, your fault, you can make a recovery for the percentage of blame you do not share.
For example, if your damages total $100,000, but you but you bear 10 percent of the blame, under comparative negligence, you would receive $90,000 in compensation.

This law firm is absolutely amazing. They took on my case, when nobody else would! They fought hard for me when it seemed there was no hope. They kept me informed and always asked for my input before making decisions on my case. Gary puts himself into every case unlike most law firm owners. Gary and his team really care about every one of their clients, and fights hard to get you a fair settlement. They actually won my case out of court, and then reduced my fees to make sure I could get my car fixed and be able to get back to some normality. I would recommend Burger Law over and above any other firm! If you go somewhere else you aren’t getting the best!
