Our client was traveling on Big Bend when she was rear-ended by someone who only had the $25,ooo minimum required insurance limits. She sustained injuries to her neck, back, and head, including post-concussion syndrome.

As we often do, we submitted a bad faith settlement demand pursuant to RSMo. § 537.058 seeking the underlying $25,000 policy limits. The $25,000 was eventually offered, but it was insufficient to fully compensate our client for her injuries.
Fortunately, our client also carried underinsured motorist (“UIM”) coverage. This isn’t the first — and won’t be the last — time we discuss this issue. We have written articles in the past about the importance of obtaining this type of insurance on your own personal policy, and this is yet another example. You cannot rely on the insurance coverage of other drivers (who are strangers) to be there for you when you need it most.
